Atomic Events is Charl Van Zyl T/A Atomic Events, a Sole Proprietor.

Atomic Events offers freelance Audio Visual services, and the bookings of bands and performers.

  1. Booking and payment
    • You will receive a quotation from Atomic Events, based on your specific requirements. We require a signed copy of this quotation to be returned to us, or you may confirm in writing via email.
    • Once we receive your signed quotation, or written confirmation, we will issue and invoice for your event, which is valid for 14 days.
    • To confirm Atomic Events we require a minimum of a 50% deposit of the invoice amount, with the balance of the transaction to be paid in full at least 7 days prior to the event.
  2. Confirmation and cancellation of order
    • Payments will only be accepted as valid once full payment reflects in Atomic Events bank account, in cleared funds.
    • You event will be confirmed when payment is received for the full invoice amount.
    • Any cancellation must be made no less than 90 days prior to the scheduled event.
      • Notification of cancellation must be in writing
      • If cancelled within 90 days of event, 25% of the deposit/payment held by Atomic Events will be retained.
      • If cancelled within 60 days of event, 50% of the deposit/payment held by Atomic Events will be retained.
      • If cancelled within 30 days of event, 100% of the deposit/payment held by Atomic Events will be retained.
    • There will be no discount or refunds given for events where cancellation is the result of an act of god, force majeure, national disasters, national states of emergency , military/police or government actions, strikes, or weather events which prevent Atomic Events from executing the contracted duties. 
    • In the event that an occasion must be re-scheduled/postponed due to rain or any other weather circumstances, Atomic Events will endeavor to transfer any deposits based on the availability of the DJ/Performer/Technician and of Atomic Events.
    • There will be no discount or refunds given should and event finish earlier than the contracted period.
  3. Delivery of equipment and provision of services
    • Atomic Events will deliver the goods and provide the services at the time and place stipulated on the Invoice.
    • In the event that the Customer requires Atomic Events provide any additional Equipment and/or Goods or Services not reflected on the quotation, Atomic Events shall be entitled to issue a new invoice for such Equipment and/or Goods or Services at Atomic Events usual price for leasing such Equipment and/or designing and manufacturing such Goods and providing such Services.
    • Any electrical power required for the provision of the Services shall be provided by the Customer to Atomic Events free of charge. In the event that no electrical power or insufficient electrical power is provided by the Customer then Atomic Events may, but is not obliged to, proceed to install the Equipment and/or Goods by making use of power that it has sourced, or provided, and in such event the Customer shall be liable for all costs associated with the provision of such power;
    • In the event that Atomic Events is unable to supply the Equipment specified in the quotation, for whatsoever reason, Atomic Events reserves the right to provide the Customer with alternative comparable Equipment capable of satisfying the Customer’s requests as recorded in the quotation and subsequent written agreement.
    • Atomic Events shall, in its sole discretion, and without the consent of the Customer, be entitled to employ sub-contractors to carry out any of Atomic Events contractual obligations herein.
  4. Risk and Ownership
    • All risk of loss, deterioration and destruction of the Goods and Equipment shall pass to the Customer on delivery and/or collection thereof;
    • Ownership of the Goods shall remain vested in Atomic Events.
    • The Customer shall still bear all risk of loss, deterioration, damage or destruction of the Equipment, despite Atomic Events being in control or possession thereof, if such loss, deterioration, damage or destruction is caused by the negligence or maliciousness of the artist, the general public, the Customer or its employees, or the Customer insisted on utilizing the Equipment in inclement conditions, including but not limited to, rain or storms.
  5. Customers obligations
    • The Customer shall:
    • ensure that all addresses of venues, set up dates, job dates and Equipment specifications are correct and accurate.
    • provide access to the venue or site for delivery of the Goods and/or Equipment and provision of the Services (if applicable) and accepts sole liability for any loss or damages it, or its client, may suffer as a result of the delivery and/or the provision of the Services not being completed by the agreed date due to the Customer not providing such access timeously.
    • ensure that the venue or site has the required certified electrical power source in the event that Atomic Events is required to provide any installation, set up or operation services.
    • provide 24 hour security at the venue for the duration of the period during which the Equipment is supplied.
    • allow Atomic Events or its representatives or agents access to the Equipment at all reasonable times for any purpose whatsoever.
    • be responsible for obtaining all necessary permits or permission and shall inform Atomic Events, in writing, that such permits or permission have been obtained.
    • ensure that fresh drinking water is available at the venue.
    • abide by all health and safety laws and regulations when utilizing the Equipment and/or the Goods and understands that Atomic Events shall have no liability or responsibilities in this regard.
    • at the request of Atomic Events, inform the owner of the venue, in writing, that the Equipment is owned by Atomic Events. In this regard Atomic Events reserves the right to contact the owner personally to ensure that he is aware of its ownership of the Equipment.
  6. Standard of dress and meals
    • The DJ/Performer/Technician will be dressed appropriately for the occasion.
    • The Client agrees to provide a meal for one (1) Atomic Events staff member during any catered engagement that operates for longer than four (4) hours. If a meal is not provided, the DJ/Performer/Technician may order in food from an outside provider, and the client will be invoiced for this after the event.
  7. Extended performance hours – overtime
    • The Client may request that the DJ/Performer/Technician performs his duties longer than the contracted performance times.
    • Atomic Events will provide an extended performance at the specified overtime rate, provided that approval has been obtained from the venue Manager if applicable. The availability of the Company for overtime cannot be guaranteed.
  8. Health and safety
    • The Client shall provide DJ/Performer/Technician with safe and appropriate working conditions.
    • DJ requires a MINIMUM of one 15 amp circuit outlet from a reliable power source within 10 meters (along the wall) of the setup area. This circuit must be free of all other connected loads.
    • The DJ/Performer/Technician, at his discretion, reserves the right to discontinue all or part of the equipment usage if the power provided is not capable of operating the equipment. without risk of damage to the equipment, the Company, personnel or the public, or if the working environment constitutes a health and safety risk.
    • The surface on which DJ/Performer/Technician’s are to play cannot be dirt, gravel, or any other unstable surface. If applicable, the customer agrees to furnish a facility that completely covers the Company’s equipment from direct sunlight and rain.
    • In order to prevent equipment damage the DJ/Performer/Technician reserves the right to deny any individual other than employees of Atomic Events access to the sound system or any other equipment in his possession.
    • Atomic Events requires a minimum of 60 minutes for setting up and 40 minutes to pack away equipment.
  9. Misbehavior
    • The Client is responsible for the conduct of all persons attending the event whether those persons are invited or not. Atomic Events do not take any responsibility for controlling rowdy behavior or ejecting unwanted persons from the venue. Our DJ/Performer/Technician’s have the right to perform in a safe environment.
    • The DJ/Performer/Technician reserve the right to cease performance should any physical, verbal abuse, or intimidating actions be made to the DJ/Performer/Technician. If the Client is able to resolve the threatening situation within a reasonable amount of time (maximum of 10 minutes), DJ/Performer/Technician shall resume performance in accordance with the original terms and conditions of this agreement. Client will be advised of any problems that we may have in this respect with any of your guests.
  10. Equipment Failure
    • The Company is not responsible for any power outages. Since every reasonable safeguard is assured the Company cannot be held responsible for any sudden malfunction or breakdown of any electrical equipment as this is an unavoidable occurrence and is outside of our control.
    • We will, however, make every reasonable effort to rectify the situation. In the extremely unlikely event that suitable back up equipment is not available, the Company will refund the portion of fees paid prorated to any time lost or if in the extremely unlikely a total failure occurs, the client will be refunded the total contracted fee in full. In this situation this will be the full extent of our liability he or she is entitled to and no further damages may be sought against Atomic Events.
  11. Injuries
    • Atomic Events is not liable in any way for any injuries that may occur due to the actions of the Clients and/or any of the Clients guests. This may include, but is not restricted to drunkenness or other forms of intoxication and misbehavior.
  12. Delays
    • If the performance start time is delayed due to the inability of the DJ/Performer/Technician to gain access to the performance area, or any other delay beyond the DJ/Performer/Technician’s reasonable control, the Company will not be liable for any refund whatsoever.
    • The same applies if the agreed performance time is cut short for any reason beyond the Company’s control.
  13. Assigns / substitutions
    • In the event of illness or any other reason, Atomic Events reserves the right to substitute the DJ/Performer/Technician assigned to the performance.
